New Federal Codes of Conduct

Recently the Commonwealth Government has released the newly approved a federal code of practice provides practical guidance to employers. The Codes of Practice are: • Work Health and safety (Sexual and Gender-based Harassment) Code of practice 2025. • Work Health and Safety (Managing Psychological Hazards at Work) Code of Practice 2024.

Recently the Commonwealth Government has released the newly approved a federal code of practice provides practical guidance to employers.

The Codes of Practice are:

  • Work Health and safety (Sexual and Gender-based Harassment) Code of practice 2025.
  • Work Health and Safety (Managing Psychological Hazards at Work) Code of Practice 2024.

The new harassment code "complements" the positive duty under the Sex Discrimination Act 1984, which requires employers to take reasonable and proportionate measures to eliminate unlawful sex discrimination, including sexual harassment.

Where the Codes are not law, they are admissible in court proceedings under OHS laws and courts can rely on them when determining what is reasonably practicable in the circumstances.
