A FWC expert panel led by President Adam Hatcher has launched a review of part-time provisions in modern awards.The review which examines how such employment should be defined and distinguished from casual work and how hours are decided on and remunerated.

The Commission's actions follow a report that found no consensus on part-time provisions. Employer organisations generally seek greater flexibility and control over setting and altering worker hours, while unions sought "greater predictability and employee control over part-time hours. However, my thinking is that it should be decided (with the appropriate safety net in place, which the awards now provide) based on the agreed understanding of the employer and the employee.

The review will possibly -

  • Redefine part-time employment;
  • Distinguish part-time from casual employment; and
  • Establish part-time workers' agreed hours.

The Commission is seeking submissions to awards@fwc.gov.au from interested parties by 4.00 p.m. on 22nd August.Further information can be accessed on the Fair Work Commissions website.
